Bio

Jodi Miller focuses her practice on commercial and other civil litigation and regulatory matters. Jodi has handled a wide variety of litigation in state and federal courts in jurisdictions involving health care, antitrust, intellectual property, corporate law, consumer fraud and protection, contract and employment issues. She has also represented clients in numerous arbitration matters.

Co-chair of the firm’s Health Care practice group, Jodi has a particular expertise in the area of health care law. As a litigator, Jodi represents health care clients in matters involving contract disputes, payor-provider disputes, MassHealth audits and investigations, and other issues. On behalf of health care clients, Jodi also drafts and negotiates a wide range of agreements for professional services, equipment, IT and other arrangements. She regularly advises clients on various compliance issues, including billing and reimbursement issues, mental health parity, HIPAA, and fraud and abuse laws.

Jodi also has extensive experience representing plaintiffs and defendants in numerous class action litigations.

Experience
  • Represent hospital system against claims for retaliation under Massachusetts Health Care Whistleblower Statute.
  • Successfully defended health plan in arbitration brought by a national hospital chain seeking millions of dollars in alleged underpayments for obstetrical services. After several days of hearings with multiple witnesses, including experts, the arbitrator ruled in favor of the firm’s client on all claims.
  • Defended health maintenance organization in an arbitration challenging termination from participate in plan network, claiming racial discrimination and retaliation under the Massachusetts Health Care Whistleblower Statute. After successfully defeating claimant’s request for preliminary relief, achieved favorable settlement on behalf of the firm’s client.
  • Represent multiple health care providers with respect to MassHealth audits and investigations, filed claims for adjudicatory hearing challenging results of such audits, and negotiated various settlements with respect to results of such audits.
  • Represented health plan in trademark infringement litigation against health care entity. Negotiated a settlement on behalf of client in which defendant discontinued use of offending trademark.
  • Obtained IRS recognition of health maintenance organization as a social welfare organization under Section 501(c)(4) of the Internal Revenue Code.
  • Regularly represents health care clients in response to subpoenas and civil investigation demands from regulatory agencies.
  • Represented former employee and minority owner of business in corporate dispute seeking damages for corporate freeze and violations of Massachusetts wage and hour law.
  • Successfully represented gas tubing manufacturer in dismissal of products liability class action which was affirmed by the First Circuit Court of Appeals.
  • Successfully arbitrated landlord/tenant dispute on behalf of an educational arts organization.
  • Represented financial institution, international transportation company and insurance company in various complex class actions, including antitrust, fraud and consumer protection, and breach of contract matters.
